Purchasers of a condominium or of a home within the jurisdiction of a community association are bound to comply with the covenants set forth in the condominium declaration, or declaration of covenants. When there is a violation, the board of directors has a fiduciary duty to take appropriate action to restore compliance.
Ansbacher Law recognizes that a lawsuit to enforce covenants is rarely desired, but sometimes necessary. We work with boards and community association managers to encourage compliance through education, warnings, and fines. However, when other efforts prove unsuccessful, Ansbacher Law has experienced trial lawyers to present the case to arbitration or trial.
