In Florida our firm, and most other real estate firms also serve as title insurance agents. This allows us to both represent our client to assure that title to the property is suitable and then to issue a title insurance policy for additional protection.
In Florida title is considered "GOOD" and "MARKETABLE" when it meets the standards promulgated by as the Uniform Title Standards (click on this link to download / open 700k PDF file). Although by law title insurance companies are not allowed to insure ownership where the title is not marketable, it is not uncommon for this law to be violated. Title insurance is not a substitute for good title as many clients later discover when making a claim. This is why it is so important to first assure that title is good then insure the title.
